Terms and Condition

Welcome to Bizdefines! These Terms and Conditions govern the services provided by Bizdefines, a web development agency, to our clients. By engaging with our services, you agree to the following terms:

1. Project Initiation & Payment Terms

1.1. A project will commence only after receiving 50% of the total project cost as an advance payment. 1.2. The remaining 50% must be paid before the project is uploaded to the client’s server or delivered. 1.3. All payments must be made in the agreed currency via the accepted payment methods. 1.4. Any delay in payments may result in project delays or termination.

2. Project Scope & Revisions

2.1. The scope of work will be defined in the project proposal. Any additional features or requests beyond the initial scope will require extra payment. 2.2. Clients are entitled to a maximum of 3 free revisions within the project scope. Additional revisions will be chargeable. However, based on the bond we establish, we may choose to offer additional revisions at our discretion. Clients cannot demand more than 3 revisions; any extra revisions beyond this limit are purely at our discretion. 2.3. Changes requested after project completion will be treated as a new task and charged accordingly.

3. Hosting & Deployment

3.1. Bizdefines will upload the completed project to the client’s server only after receiving the full payment. 3.2. We are not responsible for server issues caused by third-party hosting providers. 3.3. If deployment assistance is needed beyond the agreed scope, additional fees may apply.

4. Maintenance & Support

4.1. Clients who subscribe to our maintenance service will receive support for fixing any issues related to the developed project. 4.2. Additional feature requests, upgrades, or modifications are not covered under the maintenance plan and will be chargeable. 4.3. The maintenance plan does not cover third-party software or plugin updates unless explicitly mentioned in the contract. 4.4. If the client does not subscribe to our maintenance service, Bizdefines is not obligated to provide any support or assistance after the project has been uploaded.

5. Ownership & Intellectual Property

5.1. Upon full payment, the client receives ownership of the developed website or application. 5.2. Bizdefines reserves the right to showcase completed projects in our portfolio unless otherwise agreed in writing. 5.3. We retain the right to reuse non-client-specific code for other projects.

6. Confidentiality & Data Protection

6.1. Bizdefines will maintain confidentiality regarding all client data and project details. 6.2. We will not share client information with third parties unless required by law. 6.3. Clients must also respect Bizdefines’ proprietary methodologies and not disclose them to competitors.

7. Liability & Warranties

7.1. Bizdefines provides its services “as is” and does not guarantee that the project will be error-free or work uninterrupted. 7.2. We are not liable for losses or damages caused by third-party integrations, hosting providers, or misuse by the client. 7.3. Any disputes must be reported within 7 days of project completion; otherwise, the project is considered accepted.

8. Termination & Refunds

8.1. Either party may terminate the project by providing a written notice. 8.2. If the client cancels the project after work has begun, the advance payment will not be refunded. 8.3. If Bizdefines fails to deliver the agreed work due to unforeseen circumstances, we may offer a partial refund based on the completed work. 8.4. If the client refuses to accept the completed project despite it being delivered as per the agreed scope, they must pay the full remaining balance. Failure to do so will result in the client having no authority over the project, and Bizdefines reserves the right to delete the project at its discretion.

9. Dispute Resolution

9.1. Any disputes arising from these Terms and Conditions will be resolved through mutual discussion first. 9.2. If unresolved, disputes will be handled under the jurisdiction of West Bengal.
